Please read our policies thoroughly, as they are aimed at protecting
the best interest of our customers.
The APSIS Concept Ltd. (APSIS) seeks to enable organizations to
compete/operate on a global level, by acting as a neutral provider
of comprehensive services and access to the Internet.
Should it be determined that an account has been inappropriately
used, APSIS reserves the right to suspend or cancel a customer's
access to any or all of its services. If you are unsure whether

Unlimited Traffic
and Unlimited Storage Policies.
The APSIS concept (much pun intended) behind "unlimited traffic"
and "unlimited storage" is to provide our customers with as much
storage space and bandwidth for active web pages [see Hosting
FAQ's] as is required. APSIS is able to provide such services
based upon a large storage to bandwidth ratio.
On rare occasions, however, a site's popularity and server usage
may impair the performance of other sites on APSIS' servers. To
avoid misuse of server space please ensure that all files (*.html,
*.jpeg, *.gif, etc.) you store on APSIS servers are hyperlinked
to active web pages on your site.
CGI chat scripts are also not allowed and are considered and abuse
of bandwidth. Any cgi scripts that consume large amounts of CPU
cycles or memory are actually not allowed [see CGI
FAQ]. The user will be asked to remove any script that abuses
system resources.

APSIS Services May ONLY be used for Lawful
Purposes.
Transmission, distribution, or storage of any information, data
or material in violation of Jamaican regulation or law, or the common
law, is prohibited!
This includes, but is not limited to, material protected by copyright,
trademark, trade secret, or any other statute. APSIS reserves the
right to remove such illegal material from its servers immediately.
APSIS expressly forbids anyone from using APSIS servers for the
propagation, distribution, housing, processing, storing, or otherwise
handling in any way of lewd, obscene, or pornographic material,
or any other material which may be deemed to be objectionable. The
designation of any materials as described above is left entirely
to the discretion of The APSIS Concept Ltd.'s management.
Unlawful and/or Unethical Use.
APSIS does NOT allow sites that provide points of distribution,
participate in the act of, or provide links to the following types
of sites:
Adult Sites - Any lewd or pornographic material, links
to adults sites, or advertisements for adult sites.
Pirated Software ("Warez") - Any software that is copyrighted
and not freely available for distribution without cost. ROMs,
ROM Emulators and Mpeg Layer 3 files (MP3).
Copyright Violation -- Violation of copyrights held by
individuals and corporations or other entities can result in civil
and criminal liability for those reprehensible, and can involve
their ISP in litigation and possible loss of reputation.
Hacking / "Phreaking" - Includes sites with material,
links, or resources for Hacking, "Phreaking", Viruses, Anarchy,
or any type of site that promotes or participates in the destruction
or compromises the integrity of APSIS.
Defamation -- Defamatory speech distributed over the Internet
can result in civil liability for the defamer and litigation against
the ISP whose facilities were used to distribute the defamatory
material. Needless to say, this will not be condoned.
Distribution and/or Transmission of Obscene or Indecent Speech
or Materials -- Violation of indecency and obscenity laws
can result in criminal penalties.
E-Mail Acceptable Use.
APSIS strictly prohibits harassment via email, whether through language,
frequency, or size of messages. Forging of header information is
not permitted. APSIS does not allow unsolicited mail. This includes
"Spamming" and "Bulk Mail" sent to persons who have not requested
to receive such mail. Our objection to these methods stems from
the demands of extra bandwidth to handle their effects, further,
the Internet community generally frowns upon such actions.
APSIS Services are intended for the End
User Only.
Customers cannot sublease, sub host, or give away control of any
portion of APSIS' resources.
Violation of any of APSIS' Rules and Regulations
could result in a warning, suspension, or possible account termination.
Accounts terminated due to policy violations will not be refunded.
Payment Policies.
Payment is due each (quarterly, bi-annual or annual) anniversary
period following the date the account was established. The customer
is responsible for all monies owed on the account from the time
it was established to the time it is terminated. Please read below
for cancellation procedures.
For Credit Card Orders.
Credit card orders will be set up within 72 hrs. Accounts will be
automatically billed, on a quarterly, biannual or annual basis,
to the card number on file unless notified otherwise. E-Mail notification
will be sent five (5) days prior to payment due date. All credit
card payments will be billed on the date due - the email notification
is solely a courtesy email. In the event the credit card does not
clear with the bank, the customer will be notified by email. Past
due accounts that are not brought current within seven (7) days
of the second email notice are subject to suspension and possible
account termination.
For Cheque or Money Order Processing.
Cheques or money orders will be processed within five (5) business
days, upon receipt of payment. E-Mail notification will be sent
fourteen (14) days prior to payment due dates. Cheques returned
unpaid (NSF) will be assessed US$25.00 service charge, and the customer
will be notified as such via email. Past due accounts that are not
brought current within seven (7) days of this email notice are subject
to suspension and possible account termination.
A US$5.00 per cheque processing fee will be applied to all cheque/money
order transactions.
All payments must be in
Jamaican or U.S. currency
Cancellation.
APSIS reserves the right to cancel service at any time. All fees
paid in advance of cancellation will be pro-rated and repaid by
APSIS if APSIS institutes its right of cancellation. If cancellation
is caused by customers' violation of our policies, then no refund
will be disbursed.
Customers can cancel service any time and be refunded any amount
exceeding the pre-payment of the current month. Accounts can be
cancelled by calling 876-759-5118. Payment will be made by company
cheque within 30 days of receipt of cancellation or credit card
return. The account will be cancelled at the end of the current
billing period, unless a date of cancellation is specified.
Refunds within the 30-day trial period will be full refunds. Refunds
outside the 30-day trial period and within the first year will have
setup fees deducted from the refund.
Disclaimer.
APSIS will not be responsible for any damages your business may
suffer. APSIS makes no warranties of any kind, expressed or implied
for services we provide. APSIS disclaims any warranty or merchantability
or fitness for a particular purpose. This includes loss of data
resulting from delays, non-deliveries, wrong delivery, and any and
all service interruptions caused by APSIS and its employees. APSIS
reserves the right to revise its policies at any time without prior
notification.
APSIS furthermore expects that its subscribers who provide Internet
services to others will comply fully with all applicable laws concerning
the privacy of on-line communications. A subscriber's failure to
comply with those laws will violate APSIS' policy.
Finally, APSIS wishes to emphasize that in accepting services,
subscribers indemnify APSIS for any violation of the subscriber
of the Services Agreement, or of law or APSIS policy, that results
in loss to APSIS or the bringing of any claim against APSIS. This
means that if APSIS is sued because of activities of the subscriber
that violate any law, the Services Agreement or this policy (which
is part of the Services Agreement), the subscriber will pay any
damages awarded against APSIS, plus costs and reasonable attorneys'
fees.
