Freeware:

Copyrighted software that is distributed freely, usually via the Internet, but can't be incorporated into additional program development because it is still owned by the developer/author. Some Unix programs are freeware. 

The developer, who controls distribution and future releases, may charge for the second release of the software. Generally speaking you can use—but not resell—freeware.
